When the Affordable Care Act took effect in 2015, applicable large employers were thrust into offering major medical benefits whether they wanted to or not. Recent legislation has opened a new compliance avenue that encourages employers to leverage the federal marketplace, allowing employees to choose from a wide selection of subsidized individual plans, and avoiding the need to sponsor an expensive major medical group plan. Under an individual coverage health reimbursement arrangement (ICHRA), employers satisfy ACA requirements by partially reimbursing employees, up to the affordability threshold, for purchasing a qualified, government-subsidized individual plan on the open market.

Today, more than 16 million Americans participate in the marketplace, which has created stability and attracted a wide range of well-known insurance carriers into the program. Increased participation and competition has led to lower prices and better selection for employees.
